CITY OF GLENWOOD

ORDINANCE NO. 10, FOURTH SERIES

AN ORDINANCE OF THE CITY OF GLENWOOD, MINNESOTA, AMENDING CITY CODE CHAPTER 10: GENERAL CODE CONSTRUCTION; GENERAL PENALTY, BY AMENDING §10.98(D). THE PURPOSE OF THIS AMENDMENT IS TO PROVIDE A METHOD OF NOTICE FOR ADMINISTRATIVE PENALTIES ARISING OUT OF MOTOR VEHICLE, RECREATIONAL VEHICLE, TRAILER, ATV, UTV, GOLF CART, OR FISH HOUSE VIOLATIONS OF CITY CODE.

The City Commission of Glenwood, Minnesota ordains: 

SECTION I. Chapter 10, § 10.98(D) of the Glenwood City Code is hereby amended to read as follows:

§ 10.98 SUPPLEMENTAL ADMINISTRATIVE PENALTIES.

(D)   The responsible party providing notice of an alleged violation of a provision of this code may issue a citation for the payment of an administrative penalty for the violation. Written notice shall be sent by first class mail, or in the case of a motor vehicle, recreational vehicle, trailer, atv, utv, golf cart, or fish house violation of city code, by attaching to the vehicle a notice of the violation.  A sample notice is contained in the Appendix to this chapter. In addition to payment of the administrative penalty, the party providing notice may request that the alleged violator adopt a compliance plan to correct the alleged violation.

At the discretion of the party providing notice of the alleged violation, the administrative penalty may be waived if the alleged violator promptly becomes compliant with code provisions and presents extenuating circumstances that the notifying agency determines warrant an exception.   Upon request, the time for payment of an administrative penalty may be extended 14 days.

SECTION Il. This Ordinance shall be in full force and effect from and after its passage and publication.
