NOTICE OF PUBLIC MEETING

This is to notify the public that the regular meeting of the Pope County Board of Adjustment will take place on Thursday, March 28th, 2024 beginning at or about 6:00 pm or shortly thereafter in the Pope County Courthouse to consider the following agenda items:

• Review meeting minutes from February 22nd, 2024 BOA meeting

• Review meeting minutes from February 29th, 2024 BOA Special meeting

• Old Business

o Appeal Decision for Shoreland Alteration Permit #23327 and Floodplain Permit #23328.

• New Business

o Variance hearing on the application by Kevin & Kim Banks, if granted would allow applicants relief from the Ordinary High Water Level setback standard in a Shoreland-Recreational Development (S-RD) zoning district, per section 4.3.4.A of the Pope County Land Use Controls Ordinance. Parcel is described as: Lot 2, Plat of the First Addition to Quiet Cove, Section 23, Township 126 (Leven), Range 37, Pope County, Minnesota.

o Public Hearing: A public hearing will be held to receive comments regarding the application for relief from the Ordinary High Water Level setback standard.

o Variance hearing on the application by Kevin & Kim Banks, if granted would allow applicants relief from the setback standard for a septic drainfield to a residential structure, in a Shoreland-Recreational Development (S-RD) zoning district, per section 10.20, Subdivision 3, Subpart 3.30 of the Pope County Land Use Controls Ordinance. Parcel is described as: Lot 2, Plat of the First Addition to Quiet Cove, Section 23, Township 126 (Leven), Range 37, Pope County, Minnesota.

o Public Hearing: A public hearing will be held to receive comments regarding the application for relief from the setback standard for a drainfield to a residential structure.

o Variance hearing on the application by Andrew Gaffaney, if granted would allow applicant relief from the minimum setback standard of 100 feet from the road centerline in a Non-Intensive Agriculture (A-1) zoning district, per section 6.6.D. of the Pope County Land Use Controls Ordinance. Parcel is described as being located in: Part of the Northwest Quarter of the Southwest Quarter (NW ¼ SW ¼), Section 19, Township 126 (Westport), Range 36, Pope County, Minnesota.

o Public Hearing: A public hearing will be held to receive comments regarding the application for relief from the road setback standard.

o Variance hearing on the application by Tim Heinze, if granted would allow applicant relief from the minimum setback standard of 150 feet from the road centerline in a Non-Intensive Agriculture (A-1) zoning district, per section 6.6.C. of the Pope County Land Use Controls Ordinance. Parcel is described as being located in: Part of the Southeast Quarter of the Southeast Quarter (SE ¼ SE ¼), Section 36, Township 124 (Bangor), Range 36, Pope County, Minnesota.

o Public Hearing: A public hearing will be held to receive comments regarding the application for relief from the road setback standard.

o Variance hearing on the application by John & Virgina Donner, if granted would allow applicants to expand a non-conforming structure in a Shoreland-Recreational Development (S-RD) zoning district, per section 10.16 of the Pope County Land Use Controls Ordinance. Parcel is described as being located in: Part of Government Lot 2, Section 6, Township 123 (Gilchrist), Range 37, Pope County, Minnesota.

o Public Hearing: A public hearing will be held to receive comments regarding the application to expand a non-conforming structure.

Public participation by interested parties and citizens will include an opportunity to:

1) submit written concerns and comment prior to the scheduled meeting.  All such communications will be shared with the Board of Adjustment prior to or during the meeting;

3) review the staff prepared report via Pope County website;

4) observe and/or participate in the proceedings of the Board of Adjustment meeting.
