In the Matter of the Annexation of Certain Real Property to the City of Glenwood from Glenwood Township

NOTICE OF HEARING

Notice is hereby given that a public hearing will be held on April 17, 2023, beginning at 1:30 p.m. in the Council Chambers at the Glenwood City Hall, 100 17th Avenue NW, Glenwood, Minnesota 56334, before Administrative Law Judge Jessica A. Palmer-Denig. Some participants in the hearing may appear remotely. Note that the hearing may be continued to a later date for the presentation of evidence by the parties. 

The hearing will be held to address a Notice of Intent filed by the City of Glenwood (City) seeking annexation of certain real property (Property) to the City from Glenwood Township (Township). At the hearing, all persons shall be given an opportunity to be heard orally and to submit written data, statements, or arguments concerning this matter. The hearing will be conducted pursuant to the procedures set out in Minn. R. ch. 6000 (2021), as supplemented by Minn. R. 1400.5010-.8400 (2021).

Interested persons may also submit written data, statements, or arguments concerning this matter to the Administrative Law Judge. Submissions may be made either by mail to the Office of Administrative Hearings, Attn: Star Holman, MBAU Administrator, PO Box 64620, St. Paul, Minnesota 55164-0620, or by email to star.holman@state.mn.us. All materials should be submitted so they are received by 4:30 p.m. on April 17, 2023, and such submissions shall include the docket number for this matter: OAH 71-0330-38884.

The parties to this proceeding to date are the City and the Township. The City has requested an order authorizing the annexation of the Property from the Township.

Troy E. Nelson, Obenland & Nelson Law Offices, appears on behalf of the City. Jason M. Hill, Kennedy & Graven, Chartered, appears on behalf of the Township.

The Property proposed for annexation is described as follows:

Tract 1: All that part of the Northwest Quarter of the Northwest Quarter, Section 8, Township 125 North, Range 27 West, described as follows: Commencing 10 rods North of the Southwest corner of the Northwest Quarter of the Northwest Quarter, Section 8, Township 125 North, Range 37 West; thence North 20 rods; thence East 80 rods; thence South 20 rods; thence West 80 rods to the place of beginning. Subject to highways, easements, reservations, restrictions, covenants and rights-of-way of record, if any.

Tract 2: The South 5 acres of the Northwest Quarter of the Northwest Quarter (NW¼ NW¼), Section 8, Township 125, Range 37. That part of the Southwest Quarter of the Northwest Quarter (SW¼ NW¼), Section 8, Township 125, Range 37, lying East of the Alexandria Road EXCEPT 3.66 acres of the Southwest Quarter of the Northwest Quarter (SW¼ NW¼) heretofore conveyed to the Minneapolis, St. Paul and Sault Ste. Marie Railway Company by Deed recorded in Book 17 of Deeds, page 342, and EXCEPT deed to State of Minnesota for highway purposes recorded in Book 84 of Deeds, page 8, and EXCEPT part of the Southwest Quarter of the Northwest Quarter (SW¼ NW¼) recorded in Book 99 of Deeds, page 571.

After the presentation of testimony and other evidence is complete and the record is closed, the Administrative Law Judge will issue findings and an order in accordance with Minn. Stat. ch. 414 (2022).
